The petitioner seeks bail in anticipation of his arrest in connection with Muffasil (Lakhaura) P.S. Case No. 220 of 2019, dated 01.06.2019, instituted for the offences under Sections 341, 323, 324, 354(B), 379, 447, 504, 506 and 34 of the Indian Penal Code.

The accusation in the F.I.R. is that the petitioner and others gave a telephonic message to the groom side, not to marry the daughter of the informant or else they will suffer dire consequences. When the informant along with

Patna High Court CR. MISC. No.36942 of 2020(3) dt.25-05-2021 2/3 others went to protest against such kind of a message, the accusation was denied by the petitioner and others and the informant and others were also ill-treated, abused and assaulted.

The learned counsel for the petitioner has submitted that there is no specific accusation against anyone of the accused persons including the petitioner and it appears that because of some mis-communication, the informant has suspected the hands of the petitioner and others in disturbing the proposal of the marriage of the daughter of the informant.

There is no allegation also in the F.I.R. of anyone of the accused persons or the petitioner having harboured any intention of marrying the daughter of the informant. Considering the nature of accusation which is highly general and omnibus, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of

No.36942 of 2020(3) dt.25-05-2021 3/3 the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Muffasil (Lakhaura) P.S. Case No. 220 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
