Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 363, 365 and 384/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other co-accused persons had kept husband of the informant under their captivity and demanded ransom.
It has been submitted on behalf of the petitioner that he is in custody since 3.4.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. The first Chargesheet was submitted in the case finding the petitioner guilty for the offence under Sections 363, 365, 384 and 34 of the Indian Penal Code. Later on, a supplementary Chargesheet was filed, which is Annexure-5 to the supplementary affidavit, during the pendency of the present application which indicates that the case has been found true only under Sections 341 and 342 of the Indian Penal Code against the petitioner. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VII, Gaya, in connection with Delha P.S. Case no. 68 of 2016, G.R. no. 1722 of 2016.
