Petitioner is in custody in connection with Hussainganj P.S. Case No. 166 of 2017 for the offence under sections 302, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has been named in the instant case only on the ground that he has threatened the dire consequences in connection with another case.

Learned counsel submits that co-accused Pradeep Thakur, Hare Ram Yadav and Tunna Khan have been granted bail in the instant case. He submits that petitioner has remained in jail for nearly 8 months and at the relevant time he was

Patna High Court Cr.Misc. No.22587 of 2018(3) dt.17-05-2018 2/2 behind the Bar and as such petitioner has also claimed alibi in the instant case.

Considering the fact that other co-accused have been granted bail and the petitioner has remained in custody for nearly 8 months, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Hussainganj P.S. Case No. 166 of 2017 on the condition that one of the bailors should be pairvikar of this case and other bailor should be member of the Panchayat.
