JUSTICE SUDHIR SINGH ORAL ORDER 25-06-2015 The petitioner is apprehending his arrest in connection with Saur Bazar PS case No. 489/2013 for the offence under section 147, 148, 149, 341, 323, 386, 379, 504, 506 of the Indian Penal Code.

Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that when the informant was taking tea accused persons including the petitioner came and surrounded him and his father and thereafter co-accused Navin Yadav threatened him by saying that on 30.10.2013 when he asked for Rangdari of Rs. three lakh whey the same has not been paid yet. On which the informant allegedly showed his inability thereafter all the accused persons abused and assaulted him and his father. Thereafter co-accused Navin Yadav took a sum of Rs. 22,000/- from his pocket and threatened to pay the rest amount within 24 hours or else they will face the dire

It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent. Further it has been submitted that from the perusal of the FIR it would appear that the allegation of demand of money has been made against one Navin Yadav. As far as petitioner is concerned, he has falsely been implicated in the present case. It has further been submitted that the petitioner has got no concern with the said Navin Yadav and there is no specific allegation against the petitioner. On behalf of the State it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri B. K. Singh, Judicial Magistrate, 1st class, Saharsa in connection with Saur Bazar PS case No. 489 of 2013, subject to condition as laid down under section 438(2) of the Cr. P.C.
