JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-05-2017 The petitioner is in custody since 31.01.2017 in connection with Chausa P.S. Case No. 17 of 2017, registered for offences punishable under Sections 341, 323, 307, 354, 448, 504/34 Indian Penal Code.
Allegation against the petitioner and other co-accused persons is of assault to the wife of informant. It has been submitted on behalf of the petitioner that only general and omnibus allegation of assault has been levelled against the petitioner and there is case and counter case between the parties. Further the parties have not settled their disputes which will appear from impugned order itself.
Heard learned A.P.P. also.
Having heard both sides, considering the aforementioned facts and circumstances, the period of custody and also in view of the fact that a compromise petition has been filed by the informant, as such, let the petitioner above named, be enlarged on
Patna High Court Cr.Misc. No.19587 of 2017 (2) dt.04-05-2017 2/2 bail on furnishing bond of Rs. 25,000 (Rs. (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Udakishunganj at Madhepura, in connection with Chausa P.S. Case No. 17 of 2017, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
