This appeal has been preferred on behalf of the appellant under Section 14 (A) (2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 for setting aside the order dated 14.12.2022 passed in Govindganj (Malahi) P.S. Case No. 555 of 2022, registered for offence punishable under sections 342, 323, 353, 504 of the Indian Penal Code and sections 3 (i) (r) (s) 3 (2) (va) of the SC/ST (POA) Act, whereby the prayer for anticipatory bail of the appellant has been rejected.
3. It is an admitted fact that earlier the anticipatory
Patna High Court CR. APP (SJ) No.2818 of 2023(5) dt.08-09-2023 2/2 bail petition filed by the appellant was withdrawn, vide order dated 25.01.2023.
4. The learned counsel for the appellant has submitted that due to misconception, the appeal of the appellant was withdrawn.
5. The appellant may seek regular bail by the learned court below, which shall be disposed of on the date of its filing.
6. With these observations/directions, this appeal is disposed of.
