The petitioners, five in number, apprehend their arrest in a case registered under Section 307 and other sections of the Indian Penal Code.
Yogendra Poddar, the informant, named the petitioners and others and alleged that Upendra Poddar and Shankar Poddar assaulted him with iron rod and khanti on his head. Ajit Poddar assaulted Badami Devi; Bulbul Poddar assaulted Sita Devi and Ranjit Poddar assaulted the niece of the informant. It is submitted that there is a case and counter-case. The occurrence took place due to flowing of drainage water. Only the informant Yogendra Yadav is said to have received grievous
Patna High Court Cr.Misc. No.34764 of 2014 (3) dt.18-02-2015 2/2 injury. Assailants of Yogendra Yadav are Upendra Poddar and Shankar Poddar. Other injured persons got simple injuries. Considering the facts that the petitioners are not the assailant of Yogendra Yadav and other injured persons got simple injuries, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in Amarpur P.S. Case No. 119/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
