JUSTICE SHIVAJI PANDEY ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and counsel for the State as also counsel for the Informant. In this case, the petitioner is seeking bail in connection with Rajoun P.S. Case No. 64 of 2016 registered for offences under sections 366A/34 of the Indian Penal Code. As per First Information Report, an allegation has been made that the victim girl, Puja Kumari, had came out of the house to attend natural call where the accused persons kidnapped her and took away on motorcycle.

It appears it is a case of love affair and the victim girl has fled away along with the boy and entered into marriage. The victim girl has also made statement under Section 164 of the Cr.P.C. in which she has not supported the prosecution version as

Patna High Court Cr.Misc. No.27064 of 2016 (2) dt.12-07-2016 alleged in the First Information Report and has specifically stated about good relationship with the accused petitioner. Looking to the facts and circumstances of the case, let the petitioner, namely, Suraj Paswan, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 64 of 2016.
