This application for anticipatory bail arises out of Complaint Case N0. 5387© of 2018, disclosing offences under Sections 341,323,354,354A,504,506 read with Section 149 of the Indian Penal Code.

There is allegation in the complaint petition that the persons named therein teased the complainant and they attempted to outrage the complainant's modesty. The date of occurrence has been mentioned as 10.12.2018 for which the complaint case was filed on 04.12.2018.

Learned counsel appearing on behalf of the petitioner has drawn my attention to the complaint case filed by the petitioner on 28.05.2018, giving rise to

Patna High Court CR. MISC. No.40596 of 2019(2) dt.02-07-2019 2/2 Complaint Case No.2261 of 2018, based on which Digha P.S. Case No.811 of 2018 has been registered in which the complainant of the present case is one of the accused. My attention has also been drawn to Annexure-2 of this application, which is report submitted by the Police under Section 107 of the Code of Criminal Procedure, which indicates that there is dispute between the parties over passage.

Considering the above submission, this application is allowed.

Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate. First Class, Patna in Complaint Case No. 5387(C) of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
