The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that as a result of some dispute over drinking of liquor, the three accused persons including the petitioner herein along with others are said to have assaulted the informant's father with lathi, axe etc.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique reasons. There are no eye-witness to the occurrence. The petitioner is in custody since 14.8.2020 and investigation in the case has concluded. Learned counsel for the petitioner

Patna High Court CR. MISC. No.48593 of 2021(3) dt.23-03-2022 2/2 further submits that as per oral instructions received charge has been framed in the case. Petitioner is in custody since 14.8.2020 and undertakes to cooperate in the trial.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the general and omnibus allegation against the petitioner who is in custody for 1 year 7 months, the Court directs the petitioner to be enlarged on bail in connection with Falka (Pothia) P.S. Case no. 286 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-I, Katihar.
