2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 323 , 341 , 307, 506 and 34 of the Indian Penal Code .
3. As per the prosecution case , on 06.11.2023 at about 10:30 AM when informant went to the plot along with labourers, in the meantime all the F.I.R., named accused persons including this petitioner gave pressure to the stop the work and when the work was not stopped then all the accused persons armed with sharp weapons, bamboo and katta assaulted the informant due to which he received injury on his head.
4. Learned Counsel for the petitioners submits that
Patna High Court CR. MISC. No.44295 of 2024(3) dt.19-08-2024 2/2 they have falsely been implicated in this case due to land dispute . Falsity of the case is apparent from this fact alone that as per F.I.R, nine named persons assaulted informant with sharp weapons but doctor has found only one injury on the body of injured which is simple in nature . Petitioners claim clean antecedent.
5 . Learned counsel for the State opposed the bail petition of the petitioner.
6. Considering the nature of injury , clean antecedent and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM IV Patna City in connection with Agamkuan P.S. case No. 1078 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
