Petitioner seeks bail in a case registered under sections 364(A), 302 and 201/34 of the Indian Penal Code. The first information report was lodged against unknown persons but it is the specific case of the informant at the time of institution of the present case that the deceased had left his lodge in the company of the petitioner.
In course of investigation, dead body of deceased was recovered from a room. Para 33 of the case diary goes to show that landlord of the aforesaid room disclosed that three persons had come to take room on rent and out of the aforesaid three persons, one person had given his mobile no. 7301730797. The police also collected CCTV footage in which images of three persons were caught and landlord of the concerned room identified the aforesaid three persons.

No.28042 of 2016 (4) dt.29-09-2016 Moreover para 43 of the case diary goes to show that the petitioner was arrested from a lodge and mobile phone bearing mobile no. 7301730797 was recovered from his possession. It is a serious case of kidnapping and murder and the circumstances collected by the I.O in course of investigation, prima facie, indicate involvement of the petitioner in the alleged crime. Therefore, I am not inclined to release the petitioner on bail and hence, his prayer for bail Bahadurpur P.S. Case no. 142/2015 pending in the court of Sri Sushant Ranjan, Judicial Magistrate, Ist Class, Patnacity/ concerned court stands rejected.
