JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-05-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in Phenhara P.S. Case No. 58 of 2016 for offences under Section 387/34 of the Indian Penal Code.

The allegation against the petitioners is demand of Rs. 5/- lacs from the informant on mobile phone failing which the informant will have to face dire consequences. In para-3 of the petition the petitioners have stated that they have no criminal antecedent. The petitioners have remained in jail for more than five months and the charge sheet has been submitted on 19.2.2017.

No.16338 of 2017 (3) dt.29-05-2017 2/2 In the facts and circumstances mentioned above, I am inclined to enlarge the petitioners, above named, on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in connection with Phenhara P.S. Case No. 58 of 2016, subject to the condition that they will not, in any manner, influence the witnesses and will extend all proper co-operation in the conduct of the trial.
