====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------- 15-07-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with Forbisganj P.S. Case No.592 of 2015 registered under Sections 302/34 of the Indian Penal Code.

Mahendra Das, the father of the informant, was lying dead in the courtyard of Ranju Devi, the Phua' of the informant, who disclosed the informant that the petitioners and one coaccused Musahru Das poured kerosene oil on the body of Mahendra Das and set him on fire and fled away. Cause of occurrence is said to be land dispute.

Learned counsel appearing on behalf of the petitioners

Patna High Court Cr.Misc. No.27894 of 2016 (2) dt.15-07-2016 2/2 submits that while it is alleged in the F.I.R. that Ranju Devi, the 'Phua' of the informant, informed the informant that the petitioners and one co-accused Musahru Das poured kerosene oil on the body of Mahendra Das and set him on fire but in course of investigation, his 'Phua' stated that she saw the aforesaid persons fleeing away. Moreover, after knowing the real fact, the informant has filed compromise petition in the court below. It is further submitted that the co-accused Musahru Das has already been granted bail by a co-ordinate Bench of this Court vide order dated 13.05.2016 passed in Criminal Misc.14541 of 2016. The petitioners having no criminal antecedents are in jail custody since 25.05.

2016 Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbisganj P.S. Case No.592 of 2015.
