2. Petitioner apprehends his arrest in connection with Dumra P.S. Case No. 598 of 2022, registered for the offence punishable u/s 20(b) (ii) (B)/ 29 of the Narcotic Drugs & Psychotropic Substances Act and Section 30 (a) of Bihar Prohibition & Excise Act, pending in the court of learned 1st Additional Sessions Judge-cum-Special Judge, (N.D.P.S. Act), Sitamarhi.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as

Patna High Court CR. MISC. No.44426 of 2023(2) dt.22-08-2023 2/2 withdrawn.

6. However, if petitioner surrenders before the learned Court below within six weeks from today and seeks regular bail, the learned Court below shall pass order on the same day in accordance with law without being prejudiced by this order considering the fact that no contraband article has been recovered from conscious physical possession of the petitioner and some of the co-accused have been granted regular bail by the learned Court below.
