ANJANA MISHRA ORAL ORDER 01-10-2015 Heard learned counsel for petitioner no. 1 and learned Additional Public Prosecutor appearing for the State. Petitioner No. 1 Chhotu Singh Chaudhary apprehends arrest in connection with Nokha P.S. Case no. 57 of 2015 registered for the offences punishable under sections 341, 342, 332, 353, 307, 504/34 of the Indian Penal Code. Earlier petitioner nos. 2 and 3 of this application, namely, Bishambhar Chaudhary and Jitendra Gupta have been granted the privilege of anticipatory bail whereas prayer for bail of this petitioner had been kept pending subject to receipt of the case diary. Case diary has been received in this case.

Patna High Court Cr.Misc. No.21517 of 2015 (3) dt.01-10-2015 Learned counsel for the petitioner submits that save and except the fact that petitioner is the owner of Dumper which was taken away by some alleged culprits, there is no further material to indicate that this petitioner had, in fact, participated in taking away the aforesaid dumper after vacating the same. Considering the aforementioned facts and circumstances of the case, petitioner no. 1 above named, in the event of arrest or surrender in the court below within three weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nokha P.S. Case No. 57 of 2015 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
