Petitioner, already in custody, seeks bail in connection with Desari PS Case No.192 of 2012, giving rise to Sessions Trial No.345 of 2016, registered under Sections 302/34 of the Indian Penal Code.

Allegation in brief is that all three brothers turned up and one Jitendra Choudhary assaulted on the head of the informant's son and the petitioner and his brother Dharmendra Choudhary stabbed him in his abdomen as a result he died. Submission is that the main accused is Jitendra Choudhary, the elder brother of the petitioner and the petitioner is in custody since 29.11.2017.
