The petitioner apprehends his arrest in connection with Sultanganj P.S.Case No.49 of 2015 registered under Sections 420, 406, 120B and 34 of the Indian Penal Code. As per FIR, the petitioner grabbed government money amounting to Rs.3,55,682/- by not returning 335 quintal paddy taken for milling and even on inspection, neither paddy nor rice was found in his Mill.

It has been submitted on behalf of the petitioner that the petitioner is ready to deposit 20 % of the grabbed money within a period of 8 weeks.

On behalf of the State, it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, the petitioner is directed to deposit 20% of Rs.3,55,682/- before the State Food Corporation within a period of 8 weeks through bank draft. With the aforesaid condition, the petitioner, named

No.21505 of 2015 (2) dt.09-07-2015 2/2 above, in the event of his arrest/surrender in the court below within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S.Case No.49 of 2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
