JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414/34 of the Indian Penal Code and Section 25(1-B) A, 26 and 35 of the Arms Act. While, the petitioner and three others were assembling for making preparation for committing dacoity, one country made loaded pistol and mobile are said to have recovered from the conscious possession of the petitioner. The petitioner does have criminal antecedent in two cases but in the present case, he is languishing in jail custody since 26.12.2015. Investigation against him has already been completed.

Considering the aforesaid facts and circumstances as

No.26095 of 2016 (2) dt.05-07-2016 2/2 well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura (Bharahi) P.S.
