JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-04-2022 Heard Mr. Binod Kumar Pandey, learned counsel for the petitioner and Mr. Rajesh Kumar, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Madanpur P.S. Case No. 31/2021 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation, as per the First Information Report, is that the Police on getting secret information, intercepted a truck and upon seeing the Police Party 5-7 accused persons fled away. However, 5180 litres of illicit spirit was recovered from the said truck. The name of the

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case on the basis of secret information received by the Police. Learned counsel referring to paragraph-7 of the bail petition submits that the petitioner is not the owner of the truck and he is in custody since 11.5.2021.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that petitioner is not the owner of the truck, he is in custody since 11.5.2021, no illicit liquor/spirit has been recovered from possession of the petitioner, and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.40,000/- (Forty thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II-cum-
