The petitioners seek bail in anticipation of their arrest in connection with Chanan P.S. Case No. 64 of 2020, dated 30.06.2020, instituted for the offences under Sections

Patna High Court CR. MISC. No.36890 of 2020(2) dt.08-04-2021 2/3 448, 341, 323, 307 and 504/34 of the Indian Penal Code. The allegation in the F.I.R. is that the petitioners assaulted the informant and his sister-in-law by means of an iron rod.

The learned counsel for the petitioners has submitted that from the reading of the F.I.R. itself, it would appear that there was some dispute between the parties with respect to measurement of land. The petitioners are said to have insisted upon the wife and the sister-in-law of the informant to vacate the land in question for using it as a cattle home.

The injuries suffered by the victims, viz., the informant and his sister-in-law are stated to be simple in nature.

Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount

Patna High Court CR. MISC. No.36890 of 2020(2) dt.08-04-2021 3/3 each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Chanan P.S. Case No. 64 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

However, while granting bail to the petitioners, the Court below shall ascertain the correctness of the statement made by the counsel for the petitioners that the victims have received only simple injuries.
