The petitioner being the husband of the complainant is languishing in custody since 04.05.2016 in a complaint case filed for the offences punishable under section 498A of the Indian Penal Code.

Basic accusation is of torture.

It is submitted by learned counsel for the petitioner that the petitioner claims to have divorced to complainant as the complainant after six months of the marriage herself deserted the petitioner. There is no medical report on record in support of accusation of torture.

Considering the nature of accusation and the period of custody, let the above named petitioner be released on

Patna High Court Cr.Misc. No.27775 of 2016 (2) dt.05-07-2016 2/2 bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Kaimur at Bhabua in connection with Complaint Case No.612/2013.

The bail bond of the petitioner will be accepted on filing of the affidavit by the petitioner before the learned court below to the effect that he will regularly co-operate in the investigation. Non-cooperation in the investigation by the petitioner will give liberty to the learned court below to cancel the bail bonds of the petitioner.
