Petitioner, already in custody, seeks bail in connection with Bypass PS Case No.113 of 2016 registered under Sections 393, 412, 413 and 414 of the Indian Penal Code as well as under Sections 25(1-B)A, 26, 35 of the Arms Act.

Allegation in brief is that some miscreants made an attempt to robbed the informant who identified one of the person and informed the police, thereafter police apprehended Bihari Paswan who disclosed the name of the petitioner as one of the associates and from whose house two country made pistols and 17 live cartridges were recovered. Learned counsel for the petitioner submits that the recovery of the arms was made from the house of the petitioner

Patna High Court Cr.Misc. No.21348 of 2018(4) dt.26-06-2018 2/2 but his wife was apprehended and Bihari Paswan and the wife of the petitioner were granted bail by co-ordinate Benches of this Court vide orders dated 16.12.2016 and 09.01.2017 passed in Cr. Misc. Nos.53523 of 2016 and 55210 of 2016 respectively and one motorcycle was recovered from possession of the petitioner and the petitioner has no criminal antecedent. Having considered the recovery of two country made pistols and 17 live cartridges from the house of the petitioner and recovery of one motorcycle, presently the prayer of bail of the petitioner is rejected and may renew the prayer of bail after six months if the trial does not conclude by that time.
