Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in a case registered under Sections 147, 148, 149, 341, 323, 307, 504, 506 of the Indian Penal Code.

Allegation is that the accused persons including the petitioners abused and assaulted the informant. Co-accused Sonu Chaudhary and Rakesh Chaudhary assaulted the brother of the informant by dab resulting injuries on his head and neck.

No.37101 of 2020(2) dt.02-02-2021 2/2 It has been submitted on behalf of the petitioners that the petitioners are in custody since 17.09.2020 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. General and omnibus allegation has been made. No specific overt act is alleged against the petitioners. Other co-accused has been granted bail vide Annexure 3 to the present application.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Ara in connection with Koilware P.S. case No.09 of 2020.
