The petitioner being the husband of the informant is languishing in custody since 31.03.2016 in a case registered for the offences punishable under sections 120B, 406, 498A, 307, 504, 506 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
Basic accusation is of torture for non-fulfillment of dowry demand. It is alleged that an attempt was also made to kill the informant by causing burn injury.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant. Moreover, no injury was caused to the informant. The petitioner filed Matrimonial Suit No.73/2015 for restitution of conjugal
Patna High Court Cr.Misc. No.27784 of 2016 (2) dt.05-07-2016 2/2 rights and thereafter the present case has been filed. The petitioner is still ready to keep the informant as wife with full dignity and honour and investigation has already concluded. Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Lakhisarai, in connection with Mahila P.S. Case No.3/2016. (Dinesh Kumar Singh, J) Ashwini/- U T
