2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 394, 302 of the Indian Penal Code.

3. As per the prosecution case, some unknown miscreants looted cash of Rs. 1,50,000/- and ornaments of worth Rs. 1,75,000/- and committed murder of the wife of informant.

4. It is submitted that petitioner is not named in the FIR. Name of petitioner transpired during course of investigation on the basis of call detail report (CDR) and tower location of the petitioner was found near place of the occurrence. No looted article has been recovered from

Patna High Court CR. MISC. No.42123 of 2023(2) dt.31-07-2023 2/2 possession of this petitioner. Save and except tower location, there is no material against this petitioner. Petitioner claims clean antecedents.

5. Counsel for informant however vehemently opposed the prayer for bail.

6. Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Dalsinghsarai, Samastipur in connection with Angar Ghat P.S.
