1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 117(2), 118(1), 109(1), 352 and 151(2) of the B.N.S.
3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that accused persons including the petitioner came and assaulted him and his son by rod causing injury on their head.
4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that the date of occurrence is
Patna High Court CR. MISC. No.37634 of 2025(2) dt.18-06-2025 2/2 25.12.2024 and the FIR came to be instituted on 05.01.2025 i.e. after a delay of more than ten days, which cast an aspersion on the case of the prosecution. It is further submitted that even allegation of assault is not specific.
5. Learned A.P.P. opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. Sanu Kumar, the learned Judicial Magistrate, 1st Class, Begusarai in connection with Singhaul P. S. Case No.05 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
