The petitioner seeks bail in connection with Baheri P.S. Case No. 78 of 2019 for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioner. The petitioner is not involved in any illegal business of wine and he has been languishing in custody since 16.04.2019.

Considering the facts and circumstances of the

Patna High Court CR. MISC. No.36239 of 2019(4) dt.04-09-2019 2/2 case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II -cum- Special Judge (Excise Act), Darbhanga in connection with Baheri P.S.
