Heard learned counsel for the petitioner and learned A.P.P. for the State, Shri Ram Sevak Choudhary. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120B and 34 of the Indian Penal Code. 3.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and allegation is of withdrawing money from two cheques issued by father of the informant by committing forgery.

Learned counsel for the petitioner next submits that petitioner is not named in the FIR and he came to be implicated in the instant case based on the fact that the seized motorcycle belongs to him. It is further submitted that the motorcycle was

Patna High Court CR. MISC. No.37408 of 2025(2) dt.18-06-2025 2/2 being used by his brother Dharamraj and it was Dharamraj who went to the house of the informant and got the cheques from his father and subsequently the cheques were encashed in connivance with the bank officials.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nagarnausa P.S. Case No. 127 of 2023, subject to the conditions as laid down under Section 482 (2) of the BNSS.
