JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-05-2018 Heard learned counsel for the petitioners and State. The petitioners are in custody since 10.01.2017 in connection with N.D.P.S. case no. 90 of 2017, arising out of Barhariya P.S. case no. 07 of 2017 for the offence under Sections 20 /22 of the N.D.P.S. Act.
Learned counsel for the petitioners submits that during the raid six persons were apprehended including these petitioners and from the possession of these petitioners 200 gm of Charas each was recovered. The petitioner is in custody since 10.01.2017. Learned counsel submits that four accused persons, who were apprehended along with these petitioners, have been granted bail by this Court in Cr. Misc. No. 27314 of 2017 vide order dated 26.07.2017, Cr. Misc. No. 29161 of 2017 vide order
Patna High Court Cr.Misc. No.22635 of 2018 (3) dt.17-05-2018 2/2 dated 04.08.2017 and Cr. Misc. No. 22316 of 2018 vide order dated 19.04.2018.
Considering the aforesaid, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the amount each to the satisfaction of 1st Additional Sessions Judge, Siwan in connection with N.D.P.S. Case No. 90 of 2017, arising out of Barhariya P.S. case no. 07 of 2017 with the condition that the bailors should be the family members of the petitioners. (Anil Kumar Upadhyay, J) Uday/- U T
