The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30 (A), 38 and 41 of the Excise Act.

Learned counsel for the petitioner submits that there is no recover from the conscious possession of the petitioner. The petitioner is owner of the vehicle and his antecedent is very clear.
