2. The petitioner is in custody since 02.03.2016 in connection with Sabour P.S.Case No. 38 of 2016 for the alleged offences under Sections 302, 34 of the Indian Penal Code and Sections 3(II) (V) of the S.C./S.T. Act.

3. It is submitted that the petitioner has been falsely implicated as the accusation of assault with lathi, fat and fist attributed to him upon the deceased is not supported by the post mortem report which discloses no external injury on any part of the body of the deceased. The petitioner claims clean antecedents.

4. Having regard to the nature of direct accusation

Patna High Court Cr.Misc. No.27289 of 2016 (2) dt.12-07-2016 against the petitioner as well as charge sheet having been filed against the petitioner after due investigation by the police, this Court is not inclined to grant the privilege of bail to the petitioner.
