The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 295(A) and 353 of the Indian Penal Code and Section 27 of the Arms Act.

It is a case of creating obstruction in disposal of the official duties of the police by the accused persons and also

Patna High Court CR. MISC. No.50558 of 2021(3) dt.01-04-2022 2/2 misbehaved with them.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that no specific allegation of assault is against the petitioners. He further submits that similarly situated coaccused persons have been granted anticipatory bail by a Coordinate Bench of this Court. Petitioners have got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Madhepura/concerned Court in connection with Srinagar P.S. Case No. 24 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
