Although it is the contention of Mr. Sri Prakash Srivastava learned counsel for the petitioner that the claim of the petitioner has been mala-fidely rejected by the respondent Chief Engineer without even examining the claim but in view of the tenor of the order passed by this Court in C.W.J.C.No.9642 of 2013 requiring
Patna High Court MJC No.333 of 2015 (5) dt.24-06-2015 2/2 the appropriate authority to consider the representation filed by the petitioner on the issue of commission and dispose of the same within a period of four weeks and which direction of this Court stands complied in the order dated 16.5.2015 of the Chief Engineer placed at Annexure-S/1 to the show cause, I am of the opinion any grievance as to the correctness of the order cannot be examined in the contempt jurisdiction and the petitioner if so advised may question the same by filing an appropriate application before an appropriate forum.
This application is disposed of accordingly.
