2. The petitioner is in custody since 27.03.2016 in connection with Jakkanpur P.S. Case No. 68 of 2016 for the offences alleged under Sections 419, 420, 120(B)/34 of the Indian Penal Code and Section 10 of Bihar Examination Act.

3. It is submitted that the petitioner has been falsely implicated and in any event the petitioner has already suffered custody for over three months as against the maximum punishment of 6 months provided in respect of offence under Section 10 of the Bihar Examination Act. It is submitted that the ingredients of offence under Section 420 of the Indian Penal Code has not made out in the present case.

4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner Sudhir Yadav be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna, in connection with Jakkanpur P.S. Case No. 68 of 2016.
