This Court vide earlier order dated 11.05.2022 had called for a report of the concerned Additional Sessions JudgeVII, Danapur regarding factum of death of the appellant. Accordingly, the learned I/C Additional Sessions Judge-II, Danapur, Patna vide his communication dated 25.05.2022 has informed this Court that appellant, Pemdhar Rai son of Chandrika Rai has died on 28.12.2021 while undergoing treatment at Patna Medical College Hospital, Patna. Along with that report, the Additional Sessions Judge has annexed report of the Superintendent, Adarsh Central Prison, Beur, Patna

Patna High Court CR. APP (DB) No.364 of 2018(6) dt.12-10-2022 2/2 informing about the factum of death of the appellant. The report of the Additional Sessions Judge-II, Danapur is marked as Ext- 'X' for the purpose of identification.

In view of death of the sole appellant, the appeal stands abated and is consigned to the record. Accordingly, Interlocutory Application No. 02/2021 stands disposed of.
