Madhubala Verma, learned counsel for the opposite party no. 2 jointly submit that the matter has been settled amicably and there is no grievance left, hence the present petition may be allowed and the order dated 30.05.2014 passed by the learned Sub-Divisional Judicial Magistrate, Pupari in complaint case no. C1-547 of 2013 (T.R. no. 1463 of 2013) may be quashed.

I find from the record that the present matter is squarely a matter arising out of matrimonial dispute and since the same has been amicably settled between the parties, I do not find

Patna High Court Cr.Misc. No.45950 of 2014 (7) dt.14-03-2018 2/2 any reason to interfere with the criminal proceeding since continuance of the same would not be healthy to either of the parties.

In view of the settlement arrived at between the parties, I deem it fit and appropriate to quash the order dated 30.05.2014 passed by the learned Sub-Divisional Judicial Magistrate, Pupari in complaint case no. C1-547 of 2013 (T.R. no. 1463 of 2013).

The petition is allowed.
