Petitioners seek bail in connection with Roh PS case no. 39 of 2004 for offences under Sections 363, 365 of Indian Penal Code.
Learned counsel for the petitioners submits that they are not named in the F.I.R., their names surfaced in this case during investigation and they are implicated on mere suspicion. It is further submitted that the alleged victim was having friendship with Chando Yadav and petitioner usually visit the house of Chando Yadav. It is further submitted that similarly situated co-accused have been acquitted in this case after trial which is apparent from impugned order dated 30.03.2017 passed in bail
Patna High Court Cr.Misc. No.22410 of 2017 (3) dt.01-06-2017 2/2 petition no. 121 of 2017.
Considering aforesaid facts and circumstances of the case, petitioners namely Laxmi Chauhan and Ashok Chauhan are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Roh PS case no. 39 of 2004. (Madhuresh Prasad, J.) rinkee/- U T
