Petitioner seeks bail in a case registered under section 394 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, one mobile bearing mobile no. 9504197241 corresponding to IMEI no. 357903/04/404361/4 was recovered. Learned Addl. Sessions Judge rejected the prayer for bail of the petitioner on the ground that looted mobile has been recovered from the possession of the petitioner but mobile number as well as IMEI number seized from the possession of the petitioner does not tally with looted mobile and IMEI number.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
