2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 379, 414/34 of the Indian Penal Code.

3. It is alleged that the petitioner along with other co-accused has stolen a motorcycle and succeeded in fleeing away from the place of occurrence.

4. It is submitted on behalf of the petitioner is that the name of the petitioner has come in this case on the basis of confessional statement of apprehended accused. No stolen or any incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case and the fact that there is no specific overt act against the petitioner, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran, Motihari in connection with Govindganj P.S. Case No. 165/2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
