The petitioner seeks regular bail in connection with Bhabua P.S. Case No. 654 of 2017 for the offences punishable under Sections 386/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding the co-accused persons namely Munna Yadav and Vikas Yadav having threatened the informant herein with dire consequences if extortion money to the tune of Rs. 50,000/- was not paid to them.

The learned counsel for the petitioner submits that so far as the petitioner is concerned, the informant has not named him and he is not an F.I.R. named person, his name has transpired in the present case in the confessional statement of co-accused

Patna High Court Cr.Misc. No.23319 of 2018 (3) dt.02-07-2018 2/2 namely Vikash Yadav. It is further submitted that though two cases are pending against the petitioner but the petitioner is on bail in the said two cases. The petitioner is stated to be in custody in custody since 18.11.2017.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount to each the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 654 of 2017.
