JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section304B of the Indian Penal Code. Petitioner happens to be husband of the deceased and, is languishing in jail custody since 07-03-2016. The informant being mother of the deceased, lodged the present case but she did not disclose the year of marriage of the deceased nor made any allegation of illegal demand against the petitioner but even then, the officer-in-charge, Sachivalaya Police Station registered the case u/S 304B of the Indian Penal Code and the aforesaid fact goes to show that the then Officer-in-charge, Sachivalaya Police Station does not know even the primary ingredients of Section-
Patna High Court Cr.Misc. No.27353 of 2016 (3) dt.05-09-2016 2/2 304B of the Indian Penal Code. However, after investigation, charge sheet u/S 306 of the Indian Penal Code has been submitted. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sachiwalaya P.S. Case No. 24 of 2016 to the satisfaction of Smt. Seema Kumari, J.M.-Ist Class, Patna. (Hemant Kumar Srivastava, J) A.K.V./- U T
