JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-302/34 of the Indian Penal Code.
Petitioners are not named in the first information report but in course of investigation, the name of petitioners came in paragraph-50 of the case diary, when the cousin brother of the deceased claimed that petitioners had managed one Gulshan Kumar and, after that, committed murder of the deceased. It would appear from perusal of the entire case diary as well as submission of the parties that except suspicion, there appears to be nothing against the petitioners. Moreover, the investigation against the
Patna High Court Cr.Misc. No.27359 of 2016 (3) dt.05-09-2016 2/2 petitioners has already been completed.
Accordingly, petitioners named above, are directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bihpur (Jhandapur) each P.S. Case No. 312 of 2014 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Naugachia, Bhagalpur.
