The petitioner who is in custody since 24.04.2019 has filed the instant application for grant of bail in connection with Excise Case No. 482 of 2019(arising out of Makhdumpur P.S. Case as No. 176 of 2019) registered for the offence punishable under section 30(a) of the Bihar Prohibition & Excise Act, 2016. As per the allegation in the FIR, 24 bottles containing a total of 16.600 litres of IMFL were recovered from the two accused i.e. the petitioner and one Raushan Kumar. It is submitted by learned counsel for the petitioner that the co-accused Raushan Kumar has been enlarged on bail by order dated 04.06.2019 passed in Cr. Misc. No. 36035 of 2019 and the petitioner is in custody since 24.04.2019. The application for bail has been opposed by the learned

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Jehanabad in connection with Excise Case No. 482 of 2019 (Arising out of Makhdumpur P.S. Case No. 176 of 2019).
