The petitioner prays for quashing of order dated 02.12. 2011, passed by the District Magistrate,Jehanabad, by which he has upheld order dated 23.10.2007, passed in Supply record no. 67 of 2010 by the SDO (Licensing authority), Jehanabad, whereby the PDS licence no. 02 of 1989 was cancelled.
The petitioner submits that he was already inflicted punishment of suspension of his licence by order dated 27.6.2007 and as such could not have been saddled with another punishment cancelling his licence. In support of his submission, the petitioner has relied upon a division bench
Patna High Court CWJC No.6080 of 2012 (3) dt.04-08-2015 decision in LPA no. 15 of 2011 and analogous appeals disposed of on 4.2.2013.
In the circumstances, the impugned order by which the licence of the petitioner has been cancelled by respondent no. 2 and 3 are set aside.
The writ petition is thus disposed of.
