The petitioner apprehends his arrest in a case registered for the offence under Section 420 of the Indian Penal Code and Section 66 of the I.T. Act.

As per the prosecution case, four miscreants were seen tampering with the A.T.M. situated in Jaganpura and out of them, one co-accused Kamakhya Narain Chandan was arrested by the police, who disclosed the name of petitioner and other two co-accused, as his associates, who fled away from the place of occurrence.

It is submitted on behalf of petitioner that save & except confessional statement of co-accused, there is no other substantive material against this petitioner. No incriminating article has been recovered from the possession of this petitioner and he has got clean antecedent.

Patna High Court CR. MISC. No.49483 of 2021(2) dt.21-06-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as clean antecedent of petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - XIII, Patna in connection with Ramkrishna Nagar P.S. Case No. 292 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
