JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2015 Both the above stated petitions arise out of Kurtha P.S.Case No. 172 of 2014 registered under section 302, 376,201/34 of the Indian Penal Code and section 4 of Prevention of Children from Sexual Offence 2012 and accordingly both the above stated petitions are being disposed of by this common order. The dead body of informant's grand daughter was found in the field of one Saroj Kumar and in course of

Patna High Court Cr.Misc. No.12420 of 2015 (3) dt.05-05-2015 2/2 investigation, it came to light that father of petitioner in Cr. Misc. No.12420 of 2015 had established illicit relation with the deceased and the above stated illicit relation caused annoyance to the mother of petitioner in Cr. Misc. no. 12420 of 2015 and the mother of the above stated petitioner committed murder of the deceased. The confessional statement of mother of petitioner in Cr. Misc. No. 12420 of 2015 was recorded and on her confessional statement the books etc of the deceased were recovered.

Taking into consideration the above stated facts and circumstances and also this aspect of the matter, that nothing has come against the petitioners in course of investigation, let the petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District & Session s Judge, Jehanabad in Kurtha P.S.Case No. 172 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
