2. The petitioner is in custody since 28.12.2016 in connection with Kadwa P.S. Case No. 321 of 2016 for the offences alleged under Sections 272/273 of the Indian Penal Code and Section 30(a) and 37(a) of the Bihar Prohibition Excise (Amendment) Act, 2016.

3. It is submitted that the petitioner has been falsely implicated in connection with alleged recovery of 658 litres of illegal wine from the vehicle of which the petitioner was the driver. It is submitted that according to the seizure list, the recovery is of only 312 litres of illegal wine.

4. Having regard to the nature of accusations and gravity of the offence alleged, this Court is not inclined to grant the privilege of bail to the petitioner. The bail petition stands dismissed.
