Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 302 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner had earlier moved before this Court seeking regular bail by filing Cr Misc No. 83994 of 2024 and the same was permitted to be withdrawn by order dated 11-12-2024 (Annexure-1) with liberty to the petitioner to renew his prayer for bail after framing of charge. It is next submitted that petitioner thereafter filed Cr. Misc No. 20523 of 2025 in terms of the liberty granted to the petitioner to renew his prayer for bail by an order dated 11-12-2024 in Cr. Misc No. 83994 of

Patna High Court CR. MISC. No.49544 of 2025(3) dt.18-07-2025 2/3 2024, but then Cr. Misc No. 20523 of 2025 came to be rejected by an order dated 2-5-2025 on the ground that order of framing charge was not annexed, when it was contended that charges against the petitioner was framed on 9-1-2025. 4.

It is next submitted that the instant bail application has again been filed in terms of the liberty granted to the petitioner by order dated 2-5-2025 in Cr Misc No. 20523 of 2025. It is further submitted that charges against the petitioner have been framed by order dated 9-1-2025 (Annxure-P/5). 5.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sabour P.S. Case No. 662 of 2023.

One of the bailors of the petitioner shall be his father, Md. Nasho @ Nasir.

It is made clear that if the learned trial court comes to a conclusion that the petitioner after his release is trying to
