JUSTICE SUDHIR SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 409, 406 and 504 of the I.P.C. In short, the prosecution of the case is that the petitioner being lecturer was absent from 25.4.2013 to 24.5.2013 from his duty and therefore he was instructed by the Principal not to take further classes but the petitioner came and abused the academic Incharge who compliant to the Principal and thereafter he with antisocial elements came in the college and forcibly put his signature in attendance register and he being A.N.O. of N.C.C. of the said college did not return the articles i.e. clothes, batch, balet etc of N.C.C. earlier handed over to him.
Patna High Court Cr.Misc. No.20823 of 2015 (2) dt.09-07-2015 On behalf of the petitioner, it is submitted that a complaint case was filed by the wife of the petitioner, vide Annexure-2, dated 7.6.2013 and the present case has been instituted in retaliation to the same, which is dated 15.7.2013. It is further submitted that the petitioner had demanded for an inquiry in respect to the irregularities which have been committed by the Principal and other staffs of the College.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the facts aforesaid, let the above named petitioner, in the event of his arrest or surrender in the Court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Kazi Mohammadpur P.S. Case No. 244/2013, subject to the conditions as laid down u/s 438 (2) Cr.P.C.
